Taken: International Child Kidnapping Cases under the Hague Convention

Faculty: Patrick H. Stiehm
Air Date: October 4 2013 1:00pm

Description

Please note: This course is available for Guardian ad Litem credit in Virginia ONLY.

You are an experienced and respected family law lawyer. You handle a verity of family law matters and are frequently appoint by the court as the Guardian ad Litem for children. Then one morning, you receive an email from a mother in the Republic of Ireland. She tells you her former husband has abducted their daughter from her home in Ireland and is now living with her in your city here in the United States. She wants to know if you can help her. You are vaguely aware of the Hague Convention on the Civil Aspects of International Child Abduction, but have never handled a case under that treaty. What do you do? Patrick Stiehm is a veteran of the Hague Convention wars. He will take you through the handling of such a case in federal and/or state court using the Hague Convention and the implementing congressional legislation.  This area of family law is unique and outside the normal experience of even veteran family law and civil litigation attorneys as well as many federal and state court judges.  While this CLE emphasizes representing parents outside the United States who are seeking legal counsel to recover their children, those representing the parent in the United States should find it helpful and informative.

Learning Objectives:
I.   Represent clients in federal & state court using the Hague Convention & the Child Abduction Remedies Act
II.  Grasp special rules that have been fashion by the treaty, the implementing legislation & court decision, all of which are designed to carry out the purpose of the treaty and to put the US in sync with its treaty partners in dealing with the emotional and highly charged issues surrounding international parental kidnapping;
III.  Achieve an expedited handling of your Hague Convention case and hopefully avoid undue expense and get quick resolution
