In today’s unsettling economic times, there has been a rise in bankruptcy filings and attorneys are often litigating on behalf of creditors and debtors in bankruptcy court. In this CLE program, business litigation attorney Jim White will provide an important primer on how to resolve bankruptcy controversies in adversary proceedings, as opposed to in contested matters. Using the federal bankruptcy rules as guidance, Mr. White will explain how to bring an adversary proceeding, the four basic jurisdictional issues that arise, and what type of matters can be resolved through this proceeding. This course will also include a comparison of the service and response time rules in adversary proceedings and traditional federal cases, insights into getting settlements approved by the Court, orders entered into the proceedings, and when Jury trials are allowed. This program is a must see for all new bankruptcy practitioners or any attorneys whose clients may be confronted by bankruptcy litigation issues.
