In 1999, Texas passed the Texas Medicaid Prevention Act (TMFPA) and became one of only 8 states in the country to have a Medicaid only version of the Federal False Claims Act (FCA). Join Lara Silva, former Assistant Attorney General for Texas, for this CLE presentation demonstrating why TMFPA is the single most effective tool for the government to combat Medicaid fraud. Ms. Silva begins the presentation with a brief history of FCA and a comparison of the similarities and differences of FCA and TMFPA. She then defines who the relators are who bring actions under the Act, the circumstances when the government decides to intervene, and how attorneys can best position their cases. The program also sheds light on when cases are under seal, the rules governing disclosure of documents, and the investigative tools outlined in TMFPA. Concluding with Ms. Silva’s insights into civil awards to relators under both federal and state laws and new developments in this area, this course is extremely useful for all Texas civil litigators.
