When New York’s Marriage Equality Act (“Marriage Equality Act”) became law on July 24, 2011, many same-sex couples rushed to marry; some even married at the stroke of midnight.  Before marrying, it behooves same-sex couples to understand their rights and obligations under the new laws and determine whether they wish to modify, clarify, or override them. Given the lack of recognition of same-sex marriage by the federal government and sister states and the ensuing complications, a prenuptial agreement is even more imperative for same-sex couples than for heterosexual couples. Attorneys Arlene Dubin and Daniel Rubin discuss prenuptial and postnuptial agreements for same-sex couples.  The key issues that are addressed in this program include: property settlement, spousal support, debts/taxes, and estate planning.
