Description
The 2003 Supreme Court ruling in Moseley v. Secret Catalogue holding that a plaintiff needs to show evidence of actual dilution was overturned by the 2006 Trademark Dilution Revision Act, which states that a plaintiff need only show a likelihood of dilution. Join Intellectual Property attorney Logan Lo in this CLE presentation that focuses on federal trademark dilution. Mr. Lo first provides a background on trademarks, and then differentiates trademark infringement and trademark dilution. The program also explains the evolution of the trademark dilution standard, and the two types of dilution (blurring and tarnishment). Finally, Mr. Lo provides an in-depth analysis of the most famous recent trademark dilution cases.
