The use of canines in police stops and investigations has become commonplace in Virginia.  In this CLE program, join Virginia Deputy Commonwealth attorney Lee Harrell as he discusses the constitutionality of law enforcement using narcotics-detection dogs to search for contraband and convict guilty parties at trial.  Mr. Harrell begins with a brief review of the 4th amendment and how narcotics-detection dogs can generally be used in Virginia.  He then goes into detail on how canines can lawfully be used in vehicle stops with or without probable cause.  Mr. Harrell also discusses the steps that law enforcement must take to establish a canine’s reliability in court in conjunction with the dog trainer’s testimony.  This is an excellent course for criminal prosecution and defense attorneys in Virginia who need to develop ammunition to prosecute or defend drug possession cases.
