Fixing a Retirement Plan's Problems before the IRS Comes Knocking

Faculty: Brigette Renaud
Production Date: July 29 2011

Description

In a perfect world, employers would be able to set up and execute a company retirement plan without problems. In reality, however, the constant change in tax laws as well as human error can cause problems to occur.  Join Pension and Tax Law attorney Brigette Renaud in this program that discusses The Employee Plans Compliance Resolution System (“EPCRS”) – the entity responsible for ensuring that employee retirement plans [such as 401(a)’s and 401(k)’s] are in compliance with applicable tax laws and regulations.  Ms. Renaud reviews two methods that employers can use to correct errors in their programs (the Self Correction Program and Voluntary Correction Program) depending on the circumstances. She also explains what employers can do if the EPCRS reveals a failure in a retirement plan through an audit.  Ms. Renaud’s presentation will help attorneys advise employers and administrators on how to avoid mistakes and quickly resolve any problems in their company’s retirement plan.
