An Overview of O-1 and O-2 Visas

Faculty: Merrill Cohen
Production Date: May 2 2011

Description

Immigrants seeking to apply for permanent residence through EB-1 Visas often cannot meet the exhaustive requirements. Fortunately, there are less-stringent temporary visas that are accessible to aliens who show sustained acclaim or recognition (science, education, business, or athletics) or prominence (arts) in their respective fields.  In this course, Program Attorney Kyle Robinson interviews Attorney Merrill Cohen. Ms. Cohen discusses how O-Visas can be used as a “stepping-stone” towards permanent residency and the requirements for O-Petitions.  Ms. Cohen then provides clear examples of the various categories of evidence that can be provided in support of a petition.  She also reviews the documents of third parties (such as the applicant’s employer and peer groups) that are required to be submitted in the petitions. Ms. Cohen's engaging dialogue and practical tips will be extremely useful for attorneys whose clients who may qualify for O-1 or O-2 visas.

Agenda:
I.        Introduction to O-Visas (Filing Procedures and Requirements)
II.       Categories of Evidence to Show “Sustained National or International Acclaim” for O-1 Visas (Non-Artists)
III.     Categories of Evidence to Show “Prominence” for O-1 Visas (Non-Film/TV Artists)
IV.     O-2 Visa Requirements
V.      The O-Consultation Requirement
VI.     Challenges to O-Petition Approval (N.O.I. and Revocation)
