Scrutinizing the actions of the police officer in a DWI arrest can be essential to both the prosecution's and defense's arguments. As such, both parties must have a comprehensive understanding of all the steps involved in administering the DWI Detector and Field Sobriety Tests. In this program, former prosecutor and current public defender David Rynkowski reviews the protocols that officers must follow when conducting a DWI investigation, from when they can stop a "vehicle in motion" to the pre-arrest screening. In order to demonstrate the standard sobriety tests and what they are used to prove, Mr. Rynkowski administers them on a cooperating volunteer. He then provides his insights into how prosecutors can use the test results to prove the defendant was driving while intoxicated, and how defense attorneys can demonstrate the inherent problems with the tests to prove a client's innocence. All attorneys will benefit from this enlightening presentation and learn how to best represent their clients in DWI cases as well as understand their own rights if they are ever pulled over for suspicion of driving while intoxicated.
