Description
In law enforcement and court dramas on Television, attorneys often hire aggressive investigators who dig up smoking gun dirt on their adversaries or find the last-minute witness who helps win the case. In real life, however, it is not as easy to conduct such fact-finding investigations in a legal and ethical manner. In this intriguing and eye-opening course, Professor Philip Segal discusses the various strategic fact-finding methods that can be used by attorneys and investigative professionals. Professor Segal provides helpful tips on maximizing the use of public records, properly searching databases, and avoiding the pitfalls of Google-only searches. This program also dissects the applicable federal statutes and cases which delineate the types of searches and investigations that are permissible. Professor Segal concludes with a brief analysis of how attorneys may violate the Ethical Rules of Professional Conduct through fact-finding and the scope of information that can legally be obtained through online searches and discovery of Facebook and other social networking sites. This course is a must see for attorneys looking to acquire the skills necessary to gain an edge over their opponents in litigation.
