Enacted in December 2010, the Tax Relief, Unemployment Insurance Reauthorization, and Job Creation Act of 2010 (“2010 Act”) makes significant changes to the federal estate, gift, and generation-skipping transfer tax laws. Experienced trusts and estates practitioners Kerrie C. Horrocks, Vanessa L. Kanaga, and Jenna R. Millman unpack the intricacies of this new Act and examine its affect on various provisions of the Economic Growth and Tax Relief Reconciliation Act (“EGTRRA”). Ms. Millman compares and contrasts estate taxes under EGTRRA and the 2010 Act and discusses the benefits and drawbacks of the new “portability” provision for 2011 and 2012. Highlighting a number of planning opportunities regarding charitable and institutional gifts, Ms. Horrocks details the impact of this important new legislation on gift tax exemptions and rates.
