Description
Litigating Section 1983 false arrest and malicious prosecution claims involves a number of complex procedural issues and legal principles, and requires a thorough understanding of the ins and outs of this complicated federal statute. In this presentation, criminal defense and civil rights attorneys David M. Hazen and Stuart E. Jacobs discuss the statutory elements of false arrest and malicious prosecution claims, and provide strategic and tactical insights into litigating these cases. Beginning with an examination of the statute of limitations for federal and New York State Section 1983 claims, Mr. Hazen and Mr. Jacobs elucidate complicated legal concepts and doctrines such as “probable cause”, “reasonable belief”, and the fruit of the poisonous tree doctrine. The program also covers failure to intervene claims, damages for Section 1983 claims, and prolonged arrest detention claims. With reference to a number of pivotal Supreme Court, Second Circuit and New York State cases, Mr. Hazen and Mr. Jacobs equip attorneys with the knowledge necessary to provide diligent and aggressive legal representation to clients bringing Section 1983 claims.
Agenda:
I. Introduction to Section 1983 Litigation
II. False Arrest-False Imprisonment
III. Prolonged Arrest Detention Claims
IV. Malicious Prosecution Claims
