International Asset Recovery: Litigation Strategies in English Commonwealth Jurisdictions

Faculty: Eugene Becker
Production Date: November 4 2010

Description

In order to ensure restitution for victims of high-stakes international fraud, attorneys must be well versed in both the US and international laws regarding asset recovery. In a follow up to his original course "Legal Issues in International Asset Recovery", attorney and multi-jurisdictional expert, Eugene Becker, outlines various approaches to developing an efficient asset recovery model, specifically for the English Commonwealth jurisdictions. With reference to a number of recent, international cases, Mr. Becker examines the Norwich Pharmacal, Mareva, and Anton Piller jurisdictions, and describes the ways in which claimants may use these litigation tools to their advantage. Additionally, Mr. Becker dispenses valuable advice on how to develop a complex plan for recovery (including surveillance and pulling trash) and dissects the US state and federal rules in aid of litigation involving foreign defendants. Throughout this instructive lecture, Mr. Becker shares keen insights into the intricacies of this complicated area of the law, and equips attorneys with the information they need to help their clients effect substantive recoveries.
