Some of the country's most important and interesting legal and political issues derive from civil rights litigation. These include constitutional issues involving the state or federal government, municipalities, school districts, and individual defendants. In this fascinating presentation, Scott Michelman, staff attorney with the American Civil Liberties Union (ACLU), lends his vast expertise to a detailed discussion of the ins and outs of litigating civil rights and civil liberties cases. Beginning with an overview of the importance of this diverse practice area, Mr. Michelman provides guidance on where to find plaintiffs with civil rights claims, what makes a good plaintiff, and the factors that an attorney should consider when deciding where to sue a defendant . Mr. Michelman also explores the pleading and complaint writing process in light of the recent decision Ashcroft v. Iqbal, and examines the ways in which qualified immunity can shield government officials from liability stemming from these claims. Concluding with a conversation about his personal experience as an ACLU attorney, Mr. Michelman instructs attorneys on how to expand their practice to include a focus in this rewarding area of the law and how to best pursue justice for their clients.
