Securities Arbitration: Industry Disputes

Faculty: Jordan Kam, Richard Roth
Production Date: March 11 2010

Description

In a follow up to his original course on customers’ arbitration, attorney Richard Roth is joined by his colleague Jordan Kam to discuss the arbitration of industry disputes.  This course presents an overview of industry disputes ranging from disputes between brokerage firms to conflicts between firms and an associated person. Roth and Kam place particular emphasis on employment disputes which arise from the conflicts between brokerage firms and their former employees or independent contractors, and the defamation associated with them. The program concludes with the importance of the initial agreement, and the possibility of avoiding disputes by anticipating potentially troublesome areas.  Also, their tips on how to win injunctive relief are extremely helpful for any attorney representing a client in an industry dispute.

Agenda:
I. Types of Industry Disputes
II. Statutory and Arbitration Claims
III. Commencing Arbitration
IV. Non-solicitation Provisions and Injunctive Relief
V. Damages
VI. Documentation and Confidentiality Agreements
